Under the ordinance, the outdoor cultivation of marijuana, in any amount or quantity, is declared unlawful and a public nuisance that may be abated per this law. It limits the cultivation of marijuana to six plants on any premises.
Cultivation is prohibited on any premises within 1,000 of any school, school bus stop, school evacuation site, church, park, child care center, or youth-oriented facility.
The cultivation of commercial cannabis activity as defined in the Medical Cannabis Regulation and Safety Act, or any commercial marijuana activity, as defined in the Adult Use of Marijuana Act, or by any licensee or person required to obtain a license under either statute, is declared to be unlawful and a public nuisance that may be abated.
Any industrial hemp cultivation adequately registered with the agricultural commissioner and currently compliant with Tehama County Code Chapter 6.50 will be exempt from enforcement.
The entire cultivation ordinance can be found on the Tehama County Environmental Health website.
